What Is A Class Representative?
A class representative is a person who speaks for a group of similar people who have been harmed by the actions of another.
What Is A Payment Protection Plan?
Many banks and credit card companies offer “payment protection plans.” These plans have different names, but they are designed to provide peace of mind to customers. If a cardholder is injured or loses his or her job, the bank or card company should pay, suspend or cancel the required minimum monthly payments.
What Did The Banks And Credit Card Companies Do Wrong?
Some banks and credit card companies knowingly sold their payment protection plans to cardholders who were not eligible to receive benefits, such as retirees, the unemployed, part-time workers, and people employed by family members.
Also, some of them purposely broke the laws that require them to give cardholders specific information about the payment protection plan before enrolling cardholders in the program. In many cases, the companies would enroll cardholders on the phone, and would not mail information to the cardholders that cardholders needed in order to make an informed decision about purchasing the payment protection plan.
In many cases, the credit card companies and banks would receive regular payments from cardholders for payment protection, then would deny cardholder claims for benefits and not refund the money paid for the payment protection.
What Does The Class Action Allege?
The class action lawsuit alleges that these banks and credit card companies engaged in unfair, deceptive, unconscionable and bad faith business practices through their advertising, marketing, and administration of payment protection services. The case includes the following counts:
• Breach of Contract and Breach of the Covenant of Good Faith and Fair Dealing
• Unconscionability
• Violations of State Consumer Protection Laws
• Unjust Enrichment
What If I Did Not Try To Use Payment Protection Benefits?
Because of the way the payment protection plans were marketed and administered, not all cardholders need to have been denied payment protection benefits to be eligible for the class action.
