Fighting for results for injured Marylanders
Since 1985, Plaxen Adler Muncy has recovered over $500 million for injured clients, including major verdicts and settlements in automobile accident, personal injury, premises liability, wrongful death, and defective product cases.
Some of our notable recoveries include:
A woman suffered a leg injury requiring surgery after a head-on crash with an off-duty police officer.
An individual was tased at a grocery store for wearing a mask during the pandemic.
A family was struck by a vehicle that turned left in front of them in Montgomery County.
A client was injured in a slip and fall at a Giant Food Store.
While past results cannot predict the outcomes of future cases, we’re proud to have helped so many clients secure meaningful compensation for their injuries.
Vehicle accident lawyers serving clients throughout Maryland
Motor vehicle collisions are one of the most common reasons people turn to Plaxen Adler Muncy. Our attorneys help injured drivers, passengers, motorcyclists, bicyclists, pedestrians, rideshare passengers, and families after serious crashes throughout Maryland. From the busiest Maryland roadways, like I-270, I-95, and I-495 (Capital Beltway), to quiet local streets, automobile accidents remain a serious risk to safety.
While the state tracks fatal crash data through Zero Deaths Maryland in an ongoing effort to reduce roadway deaths and serious injuries, many people still lose their lives or suffer injuries because of traffic incidents. Some roads are more dangerous than others. In fact, in Baltimore, about 60% of deadly and serious injury crashes happen on just 7% of roadways.
Car accidents
It is difficult to coordinate the medical, insurance, legal and property consequences of a car accident. We coordinate between insurance companies, help you obtain a rental car, and protect your interests in settlement negotiations or in a jury trial.
Truck accidents
A collision with a commercial truck can have catastrophic consequences. We have the skills and experience to handle complex claims involving commercial trucking companies. We can maximize your recovery for personal injuries, bodily injury, economic loss and property damage.
Motorcycle accidents
Motorcyclists have less physical protection when on the road, so it stands that they often suffer more serious, life-threatening injuries when involved in a motorcycle accident. We help injured riders in Maryland obtain the compensation they need to get well and protect their families.
Our Maryland personal injury lawyers also handle claims involving taxis and ridesharing vehicles through Uber and Lyft, as well as buses, tour vehicles and boats. We have the resources to handle complex litigation arising from train derailments and collisions, as well.
The personal injury firm you know and trust
Our firm is a plaintiffs’ personal injury firm. That means we only represent the injured. For four decades, we have been the firm your friends and loved ones have turned to when they have sustained serious, even life-altering injuries, as a result of someone else’s negligence. We proudly represent clients in cases involving:
Medical malpractice
If you suffered injury due to a hospital or doctor’s negligence, you need an aggressive and prepared advocate on your side. We handle a variety of medical malpractice claims, including surgical errors and labor and delivery errors that cause birth injuries such as cerebral palsy.
Workers’ compensation
If you were hurt on a job site or in the course of your duties, you may be eligible for workers’ compensation. We assist Maryland employees who were injured in car crashes, because of dangerous work environments, and by defective or malfunctioning tools or machinery. If you have filed a claim for compensation and were denied, we will represent you at your hearing, and we can file an appeal if necessary.
Social Security Disability
Our team assists you through the initial application process, so you have the best possible chance at obtaining benefits. If you have tried to file and been denied, we can help you with the appeal and represent you in front of an Administrative Law Judge if necessary.
Injuries on other people’s property
When you sustain an injury on another person’s property that is related to their negligence, you may be able to file a premises liability claim. Broken guardrails or stairs, being bitten by a dog, slips and falls on walkways or in buildings: all of these are common examples of premises liability claims. These incidents can happen in familiar Maryland places, from grocery stores and apartment complexes to parking lots, restaurants, shopping centers, office buildings, entertainment venues, and public gathering spaces near destinations such as Camden Yards, M&T Bank Stadium, and Merriweather Post Pavilion.
Wrongful death
If you lost someone you love due to the negligence or recklessness of another, talk to our experienced team of wrongful death attorneys. You do not have to bear the financial consequences of this tragic event by yourself.

Why Maryland injury claims require the right legal strategy
Maryland personal injury law can be unforgiving. Waiting too long, giving the wrong statement to an insurance company, or allowing evidence to disappear can make it harder to recover compensation. That is why it is important to speak with an attorney early, especially in serious injury cases.
Some factors that make Maryland’s injury cases complex include:
Negligence laws in Maryland
Maryland follows contributory negligence. If an injured person’s own negligence contributed to the injury, they may be barred from recovering compensation. This gives insurance companies a powerful reason to look for any statement or fact they can use to shift blame from their insured onto the victim. You need someone looking out for you who understands Maryland’s contributory negligence rule, the narrow exceptions and arguments that may apply, including last clear chance, reckless or intentional conduct, and how to challenge unsupported attempts to shift blame.
Time limits in different types of Maryland injury claims
Maryland’s general civil statute of limitations is three years from the date the claim accrues, unless another law provides a different deadline. For instance, claims involving the State of Maryland, local governments, public employees, public schools, transit entities, or other government defendants may involve special notice rules and shorter practical deadlines. In many cases, written notice must be given within one year.
Caps on damages in Maryland injury cases
Maryland has rules limiting noneconomic damages in many injury and wrongful death cases, which can affect the value and strategy of serious claims. It’s even more important to make sure you have an attorney who is ready and willing to calculate your real economic losses, including potential future damages like lower wages or rehabilitative treatments.

Nothing makes us prouder than hearing back from our clients. We know that we come into their lives during some of their most difficult moments. Learning that we’ve actually made a difference is what drives us to continue fighting for injury victims every day.

Thaddeus Winkey
Mr. Plaxen had great advice for me on which steps I should take. He was always available to talk and had my best interests at heart. He is a very approachable person and seemed to care about me as a person, not just a case. I would absolutely recommend the firm to others.
Alan Ghandi
They care! If they say they’re going to do something, they do it. You will always get an honest opinion, and they will lead you in the right direction.

Maryland personal injury FAQs
Your best way to have your questions answered is by scheduling a consultation with our firm. However, here are some of the questions we often hear:
What is Maryland’s contributory negligence rule, and how does it affect my case?
Maryland follows a system called contributory negligence. This policy can be somewhat unforgiving because if your own negligence contributed to your injury, you may be barred from recovering compensation. This is one reason to avoid accepting blame or giving detailed recorded statements before speaking with an attorney. However, you shouldn’t just assume you don’t have a claim. There may be exceptions or arguments we can make to fight back against defendants’ claims of contributory negligence. If you are concerned about how this might impact your case, reach out to us.
How long do I have to file a personal injury claim in Maryland?
In many Maryland injury cases, the general deadline is three years from the date the claim accrues. Some cases have different or shorter deadlines, however. For example, claims against the State of Maryland generally require a written claim within one year after the injury, and claims against local governments or their employees may also require written notice within one year. The bottom line: don’t wait. Call a lawyer right away.
How much does it cost to hire Plaxen Adler Muncy?
There is no upfront fee for a personal injury case. We represent clients on a contingency basis. What this means is that our firm only collects an attorney’s fee if we recover compensation for you. If your case settles or we win a verdict at trial, our payment comes as a predetermined percent of that award.
What damages can I recover in a Maryland personal injury case?
Depending on the case, compensation may include medical bills, lost wages, future medical care, reduced earning capacity, pain and suffering, physical impairment, disfigurement, inconvenience, and loss of consortium. Maryland law places limits on noneconomic damages in many personal injury and wrongful death cases.
How long does a personal injury case take in Maryland?
It’s impossible to give a firm answer on this one. Some cases resolve in months. More complex cases involving serious injuries, disputed fault, medical malpractice, government defendants, expert witnesses, or trial may take years. The important thing is that you don’t settle for less to try to finish the case quickly. You can’t go back once you’ve agreed to and signed a settlement, even if your injuries turn out to be worse than you realized.
Should I talk to the insurance company after my accident?
Not before speaking with an attorney. Insurance adjusters often ask questions with the intent of minimizing your injuries, shifting blame onto you, or pressuring you into accepting a quick settlement before you have a chance to speak to a lawyer and understand the full value of your claim.
