Protecting the Rights of Children with Erb’s Palsy throughout Maryland

Fighting on behalf of families whose injuries were caused by negligent doctors

Pregnancies are exciting, but they can also be complicated. You trust in your Ob/GYN to protect you and your baby throughout the process. When your healthcare provider fails to hold up to the standard of care you expect, the results can be catastrophic for the entire family. Here at Plaxen & Adler, P.A. our legal team protects you when a doctor’s negligence causes your child injury. As Maryland’s premier medical malpractice law firm, we have extensive experience and an exhaustive knowledge of how a birth injury can occur, and why injuries like Erb’s palsy are preventable. If you or your child suffered at the hands of a negligent doctor, we can protect the future of your family.

What is Erb’s palsy?

Erb’s palsy, also known as brachial plexus palsy, is a form of nerve damage affecting the upper and lower arm that is directly related to complications during the birthing process. Unlike cerebral palsy, Erb’s palsy does not affect the brain at all, and sometimes will clear up on its own. The injury usually occurs when:

  • A baby is delivered breech, so there is undue pressure on the baby’s arms
  • A medical professional pulls on the baby’s shoulder during delivery
  • The baby’s head is pushed to one side during delivery
  • The baby is particularly large
  • The shoulder gets stuck inside the mother after the baby’s head has come out

Unlike other birth defects, Erb’s palsy is entirely preventable, as these complications can largely be avoided through a Caesarian section. In the most tragic cases, the nerve separate permanently from the spinal cord, rendering the infant paralyzed in the affected arm; even now there is no conclusive evidence that surgery can repair the damage.
