What If It Was My Employer’s Fault?

If you get hurt at work because of the negligence of your employer, you have a workers’ compensation claim. Unfortunately, you don’t have a negligence claim against your employer. But, the reason for that is the great compromise of workers’ compensation in that if you get hurt at work, and it’s your own fault, you’re also covered. It works both ways with that. If it is your employer’s fault, you still have a workers’ compensation claim, and we can still get your medical bills, your lost wages, and any permanent disability covered for you.

What If It Was Someone’s Else’s Fault?

When you get hurt at work and your injury was caused by someone else – for example, if you’re leaving an appointment, going to another appointment and you get into an accident on the way there caused by someone else – you have two claims. You have a workers’ compensation claim against the workers’ compensation insurance for your employer, and you also have a claim for negligence against the person that injured you. And those cases work hand in hand. And we have the expertise to handle both the workers’ compensation claim, get you all the benefits you’re entitled to for that; and then once that’s concluded we then go after the negligent party to recover for damages that aren’t covered by workers’ comp, mainly non-economic damages that we can get back for you that are not covered under workers’ compensation.

What Happens if I Get Hurt at Work at a Social Event?

If you’re at a company social event, say a company picnic or a company softball game, and you get hurt, this is one of those areas where it really requires an attorney to look into the situation, find out all the facts, and determine whether or not you are covered. Because, in those situations, sometimes it is a workers’ compensation case. Other times, for a variety of reasons, it’s not. But it’s the perfect time to give us a call.
